This is all over the news today so I won’t belabor the point, but the Supreme Court’s decision that the EPA has authority to regulate green house gases from automobiles and other (coal) sources is a huge victory for the environment that can’t be understated. The EPA will be hard pressed to sidestep regulation under the Clean Air Act, making this yet another of several recent and decisive steps toward a national policy on regulating emissions. Welcome to the 21st century, America!
Of course the court had to blow one too. The court’s shameful sidestepping of the important case challenging the constitutionality of denying Guantanamo detainee’s the right to appear before a judge (created by the loathsome Military Commissions Act) leaves the fate of those held at the base in limbo a little longer. This little piece of legislation was sneaked through by the Republican controlled Congress prior to their abandonment at the polls last November and is virtually universally condemned and recognized as a threat to due process and American ideals.
